2 Things to Know Before Starting a Personal Injury Lawsuit

Posted on

If you are out shopping and you fall down and get hurt, you may be able to sue the store for your medical costs, your pain and suffering, and possibly your lost wages. But, there are some things that you are going to have to be aware of before you decide to visit a personal injury lawyer and start your lawsuit.

They Will Analyze Your Behavior During the Incident

One thing that you are going to be aware of is that your behavior is going to be taken into consideration when it comes to determining liability for your accident. They are going to look at several things, including whether or not you were messing around in the store, climbing shelves, running around, or other similar things. If you were behaving in an appropriate fashion for the store, then you are much less likely to be liable for your accident. But, if the lawyers for the store look at any recordings of your accident and see that you weren't being safe and appropriate, your case may be damaged.

They Will Analyze the State of the Store

Another thing that you are going to have to think about when it comes to filing your lawsuit is what kind of shape the store is in. For example, if the store had a leak that wasn't being repaired and wasn't appropriately marked, then their liability may be more obvious. Likewise, if they aren't taking care of the snow and ice out front of the store in the wintertime and you slipped in an icy patch, your case may be stronger.

Because some of these things can be hard to prove some time after your accident has happened, for whatever reason, then you will probably want to document the circumstances as soon as possible. If you can, have someone take a picture of the surroundings where you had your accident. If you can't right then, have someone go back as soon as possible to show what the physical setting was. Pictures, especially multiple pictures from multiple perspectives, are going to go a lot further in proving your story and your case than telling everyone what happened will. That's because your memory may subconsciously alter things, but the pictures are a piece of concrete proof and their memories can't change.

If you fell and got hurt at a store, you may have a good case against the store to pay for all your medical costs. Learn more about how to bolster your cast by contacting services such as Radano & Lide.
